Worldwide Asset Exchange (“WAX”), its affiliated companies, and their partners offer unique and exciting products and services related to Non-Fungible Tokens (NFTs), digital collectibles, games, and merchandise, exchangeable virtual items (vIRLs), and decentralized applications (dApps) and communities, all building on the WAX global, secure, eco-friendly blockchain, including:

And many more! In this policy, we will refer to these services, collectively, as the “Services”.

WAX tokens may also be bought and sold on secondary marketplaces offered by third parties, such as those listed at https://www.wax.io/.

We do not control your relationships with third parties or those third parties’ privacy practices, including our partners and any third party websites or applications to which we or others provide links. Please check the privacy policies for these platforms, websites, and applications for information on how they handle your personal data.

  • Your Data on the Blockchain

In order for the WAX blockchain to work in the secure and transparent manner intended, it is essential that there be a publicly accessible record of the history of all sales, trades, and transfers of a digital item. This means that certain data, such as your anonymized WAX blockchain account name, cannot be removed once it is part of the permanent blockchain record. This is true for all blockchains, not just WAX. That’s how blockchains work. However, if you delete, transfer, or close all of your WAX accounts, then your anonymized account name should no longer be publicly associated with you, unless you identify it in any of your own posts or communications with others. WAX will make no attempt to reidentify anonymized information once identifying information has been removed.

  • Scope of this Policy

This Privacy Policy describes the processing of information provided or collected on the sites and applications where it is posted, in addition to any other privacy notices on such sites or applications. This Notice does not apply to our job applicants, current employees, former employees, or independent contractors (“Personnel”).

To the extent permitted by applicable law, your use of any WAX Service signifies your understanding and acceptance of the terms of this Privacy Policy, in addition to the Terms of Service for the applicable WAX Service.

  • The Types of Information We Collect
  • Information We Collect from You Directly

When you use the WAX services, we may collect the following types of personal data directly from you:

  • Information you provide when you register for or update your accounts, use our platform, games, websites, or applications, use tokens and/or create NFTs, which may include your account name, given name, surname, postal address, date of birth, email address, username, password, security questions, and telephone number if you provide such information;
  • Information you post in public forums, communities, groups, games, or activities you engage in on our platform, websites, and applications, including your direct messages and public posts; and
  • Transaction information you provide when you request information, contact us, or purchase, return, request, or exchange a product or service or when you sell, transfer, trade or otherwise dispose of a digital item or vIRL.

The Service may allow you to submit the personal data of someone else. For example, you may provide contact information for another person if you want to invite a friend to download an application or to play a game with you. If so, the data you provide will be used to facilitate your request and is not used by us for any other marketing purposes unless we obtain consent from that person or we explicitly say otherwise. Please see our Website Terms for the WAX Service you are using for our expectations and your obligations as to data that you submit. Please be aware that when you use any send-to-a-friend functionality, your information, including contact information, name or username and message, may be included in the communications sent to the recipients of your message, and the communication will indicate it was sent at your request and/or on your behalf. By providing another person’s information to us, you represent that you have that person’s consent to disclose such information.

  • Cookies and Information Collected Automatically

We may also collect certain information from you automatically when you use our Services. For example, we collect activity information about your use of our Services, such as the content you view, how often you use our services, and your inferred preferences. Such information may include imprecise location information, including location information provided by a mobile or other device interacting with one of our sites or applications, or inferred from your IP address or other online or device identifier. We also collect information regarding your usage, viewing, technical, and device data when you visit our Services, interact with our advertisements on third-party sites or platforms, or open emails we send, including your browser or device type, unique device identifier, and IP address.

We may also collect information from website visitors using certain tracking technologies, such as cookies, web beacons (or “tracking pixels”), embedded scripts, device recognition technologies, device and activity monitoring and session replay technologies, software development kits (“SDKs”), or application programming interfaces (“APIs”). For simplicity, we will refer to these technologies collectively as “Tracking Technologies” in this Policy and the providers of these technologies as “Third-Party Digital Services”. We use browser-based Tracking Technologies (“cookies”) to transact with you, personalize your experience, analyze usage patterns, and otherwise improve our websites, products, and services.

Our cookies include:

  • Strictly Necessary Cookies are necessary to provide you with our Services. If you refuse them, you may not be able to access such Services or certain features or functionality may be limited.
  • Performance Cookies help us enhance the performance and functionality of our Services, but are not necessary for your use. Still, certain functions or features may become unavailable if you refuse them.
  • Functional Cookies collect information that is used to help us understand the use of our Services, the effectiveness of our marketing campaigns, or to help us customize our websites to enhance your experience.
  • Targeting Cookies record your visit to our Services, the pages you have visited and the links you have followed, so we can recognize you as a prior visitor and track your activity on our Services and others you visit. Certain cookies remain on your device for us to use during a next visit to our websites ("persistent" cookies). In contrast to these "persistent" cookies, some cookies ("session cookies") are deleted when your browsing session has ended.

Where permitted by applicable law, we may also allow third parties to use Tracking Technologies on our websites to collect information about your online activities over time and across different websites, applications, and devices you visit. This information is used to provide advertising tailored to your interests on websites you visit, also known as interest-based advertising, and to analyze the effectiveness of such advertising. To the extent required by applicable law, we will collect your consent before processing your personal data using such Tracking Technologies.

You may restrict, block or delete the cookies from our websites at any time by changing the configuration of your browser or deleting cookies from within your browser settings. In addition, while each browser has different settings and configurations, cookies settings can typically be adjusted in the "Preferences", “Settings” or "Tools" menu. Your browser's "Help" menu may provide additional information. You can opt out of Tracking Technologies by clicking the “Your Privacy Choices” link in the footer of our website or by navigating to settings and selecting the “Your Privacy Choices” option in our application.

There are "do not track" or similar browser choices available to internet users with respect to online web activity. However, given the present lack of consensus of what constitutes an informed election, appropriate trigger, or breadth of scope of such choice, our websites generally will not operate any differently when a "do not track" signal is received.

We may collect information using analytics and advertising cookies, including when you visit our sites and applications or use our applications on third-party sites or platforms. Such tools may include Google Advertising or Analytics Services. We may acquire information from other trusted sources to update or supplement the information you provide, or that we collected automatically.

  • Third-Party Digital Services

The Service has functionality that allows certain kinds of interactions between the Service and third-party content, web sites, applications, platform, code (e.g., plug-ins, application programming interfaces, SDKs and cookies (collectively, “Third-Party Digital Services”).

You may also have an option to use your Facebook, Google or other account provided by a Third-Party Service to interact with the Services, including by logging into the Services or posting information from the Services on the Third-Party Digital Service (or vice versa) (“Social Features”). If we offer and you choose to use Social Features, the Third-Party Digital Service providing the Social Feature may send personal data about you to us. If you use Social Features, and potentially other Third-Party Digital Services, information you post or provide access to may be publicly displayed on the Services and/or by the Third-Party Digital Service that you use, depending on your privacy settings on each. Similarly, if you post information on a Third-Party Digital Service that references the Service (e.g., by using a hashtag associated with us in a status update), your post may be used on or in connection with the Services or otherwise by us. Also, both we and the third party may have access to certain information about you and your use of the Service and any Third-Party Digital Service.

In addition, we may serve ads on other online services that are targeted to reach people on those services that are also identified on one of more of our data bases (“Matched List Ads”). This is done by using cookies or by matching common factors between our databases and the databases of the other online services. For instance, we may use such ad services offered by Facebook, X, and other third-party services. We are not responsible for such third parties’ opt-out options or their failure to comply with your or our opt-out instructions, they may not give us notice of opt-outs to our ads that you give to them, and they may change their options without notice to us or you.

  • How Do We Use Your Personal Data?

Consistent with applicable law and your choices and controls that may be available to you, we may use information collected from you, or from devices or transactions associated with you globally:

  • To transact business with you in connection with the WAX Services or token use and related transactions (e.g., requests for information about WAX, tokens, or Services) and otherwise serve you as a customer;
  • To personalize your content and experiences;
  • To assess your interests, preferences, and degree of satisfaction with the WAX platform, tokens, and/or related Services;
  • To keep you posted on new or updated WAX offerings or related products, services and/or upcoming events;
  • To provide you with targeted advertising based on your activity on our Services and on third-party sites and applications;
  • To improve the effectiveness of our Services, operations, mobile experience or marketing efforts;
  • To verify your identity and eligibility for token sales and/or related products and services;
  • To conduct auditing, data analysis, and research to improve WAX Services, and customer communications;
  • To provide customer service;
  • To prevent, deter, detect, and investigate violations of this Privacy Policy and our Terms of Service, or any fraud and other illegal activities;
  • With your consent or as permitted by applicable law, to send you marketing communications;
  • To send you important notices regarding your purchases and changes to our business policies; and
  • To comply with applicable law, including (i) complying with our obligations to retain certain business records for minimum retention periods; (ii) establishing, exercising, or defending legal claims; (iii) complying with laws, regulations, court orders, or other legal process; (iv) detecting and preventing intellectual property infringement or violations of our contracts or agreements, violations of law, or other misuse of the Services; and (v) protecting the Company’s rights or property, or yours or others’ health, safety, welfare, rights, or property.

When you create an account, you grant WAX the authority to access your account (including your public and private keys). For more information, please see our Terms of Service.

  • To Whom Do We Disclose Your Personal Data?

We may disclose your personal data when permitted or required under applicable law, including in the following situations:

  • To WAX affiliates and partners, in providing you with WAX Services and for order processing, shipping, and fulfillment;
  • To third-party service providers who support, manage and enhance our Services or customer data, provide customer service, assess your interest in our Services, and conduct customer research or satisfaction surveys. These third parties may include infrastructure and IT service providers, cloud service providers, payment processors (including, for example, third party vendors such as Stripe https://stripe.com ), shipping and order fulfillment vendors, marketing, advertising and communications agencies, external auditors and advisors, cookie analytics providers, online advertisers and analytics services;
  • To third parties who partner with us to provide Services to you;
  • To Third-Party Digital Services, as described above;
  • To enforce our Terms of Service, this Privacy Policy, or to otherwise protect our operations or users;
  • To comply with the law or legal process, enforce or apply our Terms of Service, detect, prevent, or otherwise address fraud, security or technical issues, or otherwise protect the rights, property or safety of others;
  • As part of a business divestiture, sale, merger, or acquisition of all or a part of our business or assets;
  • In the event of an insolvency, bankruptcy, or receivership;
  • To our suppliers and partners, who may provide you with SMS, email, and other communications and offers for our Services, including offers based on your interests, personal and business characteristics, stated preferences, and location; and
  • With your permission or at your direction.

In addition to the disclosures mentioned above, we may offer sweepstakes, contests, and other promotions (each, a “Promotion”), including Promotions jointly sponsored or offered by third parties, which may require you to submit personal data. If you voluntarily choose to enter a Promotion, your information, including your personal data, may be disclosed to co-sponsors, service providers, and other third parties, including to administer the promotion, to pay out rewards under the Promotion, and as required by law (e.g., on a winners list). By entering a Promotion, you are agreeing to the official rules governing that Promotion, which may include consent to additional or differing data practices from those contained in this Privacy Policy. Please review those rules carefully.

  • Your Controls and Choices

WAX, WAX affiliates, and our partners may provide you with the ability to exercise certain controls and choices regarding our collection, use, and sharing of your personal data. In accordance with applicable law, your controls and choices may include:

  • Correcting, updating, and deleting your registration account. However, in order for the WAX platform to function correctly, all transactions made by you or person(s) authorized by you on your account will permanently remain tied to the unique (anonymized) identification number associated with your WAX wallet. This information is stored within the blockchain and cannot be altered or deleted;
  • Choosing or changing your choices for subscriptions, newsletters, alerts, and marketing communications;
  • Choosing whether to receive from us offers and promotions for our products and services, or products and services that we think may be of interest to you;
  • Choosing whether we share your personal data with other companies so they can send you offers and promotions about their products and services; and
  • Choosing to control targeted advertising you receive within applications by using the settings and choices made available to you through your device(s), for example, by re-setting your device’s advertising identifier and/or opting out of interest-based ads.

If you do not allow us to collect personal data, we may not be able to deliver certain experiences, products, and services to you, and we may not be able to take account of your interests and preferences.

  • Data Security, Integrity, and Retention

The security, integrity, and confidentiality of your information are extremely important to us. We maintain a variety of security measures, including physical, electronic, and procedural safeguards that are designed to protect guest information from unauthorized access, disclosure, use, and modification. Please be aware that, despite our efforts, no system can be completely secure. Because there are so many different types of personal data, and so many purposes and use cases for different personal data, we are unable to provide retention ranges for personal data in a way that would be meaningful and transparent to you. Actual retention periods for all personal data will depend upon how long we have a legitimate purpose for the retention, consistent with the collection purposes and applicable law. For instance, we may maintain business records for as long as relevant to our business and may have a legal obligation to hold personal data for as long as potentially relevant to prospective or actual litigation or government investigation.

  • Children’s Privacy

The WAX Services are not designed for use by anyone under the age of eighteen (18) years.

If we learn that we have collected personal data from anyone under the age of sixteen (or older if applicable in a particular jurisdiction), we will take steps to comply with any applicable legal requirements to delete such information.

  • U.S. State Privacy Notice

Some U.S. states have adopted comprehensive privacy laws (“State Privacy Laws”), and residents of those states are entitled to certain disclosures with respect to our personal data processing practices. These State Privacy Laws also permit individuals, referred to as “consumers”, to exercise certain rights with respect to their personal data. At WAX, we provide these rights to residents of all U.S. states and territories, subject to certain limitations, discussed below.

The information below describes the categories of personal data we collect and examples of types of data that fit within such categories. Please also refer to the Types of Information We Collect section of our Privacy Policy above, where some of the categories below are explained in further detail.

Examples: your account name, name, postal address, date of birth, email address, username, password, security questions, and telephone number if you provide such information.

Examples: information about your use of our Services, your interactions within one of our games or Services, such as the content you view or post, how often you use our Services, and your preferences.

Examples: inferences reflecting preferences, characteristics, predispositions, behavior, and attitudes.

Examples: username and password to a WAX account.

We process the personal data described above for the purposes defined in Section 5, How Do We Process Your Personal Data.

  • Consumer Rights

We provide consumers the privacy rights described in this section. Note, these rights are not absolute and are subject to certain limitations. The consumer privacy rights we will consider are as follows:

  • The right to confirm whether or not we are processing your personal data;
  • The right to access the categories and specific pieces of personal data we have about you, and to know the source of the personal data we have about you, the business or commercial purpose for collection, selling or sharing that personal data, the categories or list of third parties to whom we disclose personal data, whether it is being disclosed or sold, and to whom it is being disclosed or sold;
  • The right to opt-out of WAX's sale or sharing of your personal data for cross-context behavioral advertising to any third parties;
  • The right to opt-out of targeted advertising;
  • The right to request and receive certain information about a company's disclosure of your personal data to third parties for their own direct marketing use, and your choices with respect to such disclosures;
  • The right to request that WAX correct any inaccurate personal data we maintain about you;
  • The right to request deletion of your personal data from WAX's possession or control, with some exceptions including where it is reasonably necessary or legally required for WAX to maintain such personal data; and
  • The right to receive equal service and pricing from WAX even if you exercise any of your privacy rights.

You may appeal our decision regarding a request by following the instructions in our response to your request.

Depending on the way in which you interact with us, you may need to use different methods to opt-out of sales / sharing / targeted advertising.

Opt-out for non-Tracking Technology Personal Data: If you would like to opt-out of the sale/sharing of your non-Tracking Technology personal data or use of such personal data for targeted advertising (e.g., your email address), you must submit an opt-out request to privacy@wax.io.

App-based opt-out: If you would like to limit our processing of your personal data for targeted advertising or opt-out of the sale/sharing of such data via app-based Tracking Technologies, you must exercise a separate opt-out request by navigating to settings and selecting the “Your Privacy Choices” option. When you select this option, a pop-up will appear to enable you to opt out. Switch the toggle to the left to opt out of sales / sharing / targeted advertising via app-based Tracking Technologies. A separate mechanism must be used to opt out of sales / sharing / targeted advertising cookie-based Tracking Technologies because we must use different technologies to apply your opt-out of sales / sharing / targeted advertising via app-based Tracking Technologies and your opt-out of non-Tracking Technology personal data.

Opt-out for Cookie Personal Data: If you would like to limit our processing of your cookie-related personal data for targeted advertising or opt-out of the sale/sharing of such data, you must exercise a separate opt-out request via our consent management tool here. Our cookie consent management tool enables you to exercise such an opt-out request and enable certain cookie preferences on your device. You must exercise your preferences on each of our websites you visit, from each browser you use, and on each device you use. Since your browser opt-out is designated by a cookie, if you clear or block cookies, your preferences will no longer be effective, and you will need to enable them again via our cookie management tool.

Global privacy control or “GPC”: The State Privacy Laws require businesses to process GPC signals, which are signals sent by a platform, technology, or mechanism, enabled by individuals on their devices or browsers, that communicate the individual’s choice to opt-out of the sale or sharing of personal data. To use a GPC, you can download an internet browser or a plugin to use on your current internet browser and follow the settings to enable the GPC. We have configured the settings of our consent management platform to receive and process GPC signals on our website, which is explained by our consent management tool here. We process GPC with respect to sales and sharing that may occur in the context of collection of cookie personal data, discussed above, and apply it to the specific browser on which you enable GPC. We process GPC for opt-outs of sales and sharing in other contexts (e.g., non-cookie personal data).

We do not engage in automated decision making or profiling as those terms are defined under U.S. State Privacy Laws. We only process the sensitive personal data of consumers for purposes that are exempt from choice under the U.S. State Privacy Laws. If you provide us with your sensitive personal data, you will have consented to such processing. We do not knowingly sell or share the personal data of consumers under 16.

Any request you submit to us must be a verifiable consumer request, meaning when you make a request, we may ask you to provide verifying information, such as your name, email, phone number, account and/or transaction information. We will not fulfill your request unless you have provided sufficient information for us to reasonably verify you are the Consumer about whom we collected personal data. We do not verify opt-outs of sale/sharing unless we suspect fraud.

Only you, or someone legally authorized to act on your behalf (your authorized agent), may make a verifiable Consumer request related to your personal data. You may use an authorized agent to make a request for you, subject to our verification of the agent, the agent’s authority to submit requests on your behalf, and of you. To make such a request, or if you have any questions or concerns about our Privacy Policy or our processing of your personal data, please contact us at privacy@wax.io.

  • Notice of Financial Incentive

From time to time, we may request that you take certain action, such as downloading another application, taking action within an application, participating in a survey, or purchasing something within or outside the Service to obtain a benefit within the application. For example, you may receive in-app tokens in exchange for taking one of the actions described above. To participate in such programs, we may require the collection, retention, or sale of personal data. The value of the incentive is calculated based on a good faith estimate of the value of the personal data, which forms the basis for offering such financial incentives. The categories of personal data that are implicated by the financial incentive or price or service difference include: Identifiers, Service Usage Data, and Inferences. Factors we consider when calculating the value of the data in order to determine what financial incentives we offer include: revenue generated by us from the collection, retention, or sale of the personal data. You may enroll in or withdraw from our financial incentive program at any time by updating your preferences in your account.

  • European Residents (including United Kingdom)

If you are a resident of the European Union, the European Economic Area (“EEA”), Switzerland, or the United Kingdom (“UK”), you are entitled to certain disclosures and afforded certain rights regarding your personal data. This section provides such disclosures and describes the rights provided under applicable law.

  • Collection, Processing, and Disclosure of Your Personal Data

WAX is the controller of your personal data for purposes of EEA, UK, and Swiss law. We may collect, process, and disclose your personal data as described in Sections 1-9 above.

  • WAX’s Lawful Basis for Processing

The lawful basis for WAX’s processing of your personal data depends on the purposes of the processing. Generally, WAX processes personal data subject to one of the following lawful bases for processing:

  • The processing is necessary for us to provide you with the Services you request (e.g., to perform a contract with you), or to respond to your inquiries.
  • We have a legal obligation to process your personal data, such as compliance with applicable tax law and other government regulations or compliance with a court order or binding law enforcement request.
  • We have a legitimate interest in carrying out the processing activity. In particular, we have a legitimate interest in the following cases:
  • To analyze your use of the service;
  • To improve the safety and security of the Services. This includes implementing and enhancing security measures and safeguards and protecting against fraud, spam, and abuse;
  • To maintain and improve the Services; and
  • To operate the Services and provide you with certain information and communications tailored to, and in accordance with, your preferences.
  • You have consented to the processing of your Personal Data. In particular, we will obtain consent before we market directly to you. When you consent, you may change your mind at any time. 
  • Data Subject Rights

Subject to certain exceptions and limitations, you have the right to ask WAX to:

  • Provide you with information about our processing of your personal data and give you access to your personal data;
  • Update or correct inaccuracies in your personal data;
  • Delete your personal data;
  • Transfer a machine-readable copy of your personal data to you or a third party of your choice;
  • Restrict the processing of your personal data;
  • Object to our processing of your personal data for direct marketing purposes or where our processing is based on our legitimate interest; and
  • Obtain information about and object to our reliance on our legitimate interests as the basis for processing of your personal data.

You may submit a request to exercise one of the rights above by sending an email to privacy@wax.io. We may request information from you to help us confirm your identity prior to processing your request. Applicable law may require or permit us to decline your request. If we decline your request, we will tell you why, subject to legal restrictions. If you have questions regarding our personal data processing or if you’d like to submit a complaint, you may contact us at privacy@wax.io. We will do our best to resolve any questions or concerns that you have, however, you may also submit a complaint to the data protection regulator in your jurisdiction.

  • International Transfers

If you are located outside of the U.S., please be aware that any information provided to us or collected by us, including personal data, will be transferred from your country of origin to jurisdictions outside the EEA, UK, or Switzerland that may not be regarded as providing the same level of data protection as the jurisdiction in which you reside.
